Prenuptial Agreements in Australia
Prenuptial Agreements are an effective way to solidify the understanding that each spouse has about the financial arrangements of a marriage. There will be less confusion in the case of a separation, as the legal rights and responsibilities have already been agreed to in a legally binding manner.
These days, Prenuptial Agreements are referred to as “Binding Financial Agreements” or BFAs. BFAs can also spell out the rights of de facto partners and in addition to being used at the start of relationships; they can also be used by separated partners to spell out who gets what property.
“Prenuptial Agreements” is a term often used interchangeably with “Binding Financial Agreements”, because most Australians still use this term and know what it means.
In Australia, when parties draft a Prenuptial Agreement they set out what assets are owned by each spouse, what liabilities exist and a range of other information about rights and responsibilities. If the marriage ends, the Prenuptial Agreement comes into force and hopefully it will make for a smooth property settlement.
